OFI: Appeal to the Athens Court of Appeal against the decision to deduct points

Next Monday (13/10) the request for a temporary injunction filed by OFI, requesting the suspension of the legal consequences arising from the decision of the EPO Arbitration Court, will be discussed at the Three-Member Athens Court of Appeal.

The request for a temporary injunction filed by OFI, requesting the suspension of the legal consequences arising from the decision of the EPO Arbitration Court, namely the deduction of three points from the championship and from every subsequent match, if it does not pay the debt to former footballer Thanasis Papazoglou, will be discussed on Monday 13/10 before the Three-Member Athens Court of Appeal.

OFI in the lawsuit against Papazoglou claims, among other things, that there is no basis for succession for clubs that were relegated and liquidated before the 2016-17 season, as happened with OFI, and that the deduction of three points from the Super League championship “will have immediate and devastating consequences for the team.”

Based on these and other allegations, “OFI 1925” requests the “suspension of the legal consequences” and the “disappearance of the decision” of the EPO court, until the discussion of the main lawsuit.

Την προσεχή Δευτέρα (13/10) θα συζητηθεί στο Τριμελές Εφετείο Αθηνών το αίτημα προσωρινής διαταγής που κατέθεσε ο ΟΦΗ, με το οποίο ζητά την αναστολή των έννομων συνεπειών που προκύπτουν από την απόφαση του Διαιτητικού Δικαστηρίου της ΕΠΟ.

Συζητείται τη Δευτέρα 13/10 ενώπιον του Τριμελούς Εφετείου Αθηνών η αίτηση προσωρινής διαταγής που κατέθεσε ο ΟΦΗ, ζητώντας την αναστολή των έννομων συνεπειών που προκύπτουν από την απόφαση του Διαιτητικού Δικαστηρίου της ΕΠΟ ήτοι της αφαίρεσης τριών βαθμών από το πρωτάθλημα και και από κάθε επόμενο αγώνα, αν δεν εξοφλήσει την οφειλή, προς τον πρώην ποδοσφαιριστή, Θανάση Παπάζογλου.

Ο ΟΦΗ στην αγωγή κατά του Παπάζογλου υποστηρίζει, μεταξύ άλλων, ότι δεν θεμελιώνεται διαδοχή για ΠΑΕ που υποβιβάστηκαν και εκκαθαρίστηκαν πριν την περίοδο 2016-17, όπως συνέβη με τον ΟΦΗ και ότι η αφαίρεση τριών βαθμών από το πρωτάθλημα της Super League “θα έχει άμεσες και καταστροφικές συνέπειες για την ομάδα”.

Με βάση αυτούς και άλλους ισχυρισμούς η “ΠΑΕ ΟΦΗ 1925” ζητεί την “αναστολή των έννομων συνεπειών” και την “εξαφάνιση της απόφασης” του δικαστηρίου της ΕΠΟ, έως την συζήτηση της κύριας αγωγής.
